Basic Eligibility
You must be in a genuine relationship with your spouse or de facto partner who is:
- An Australian citizen
- Australian permanent resident
- Eligible New Zealand citizen
You must
- To apply for this visa you must be in a genuine and continuous relationship with your spouse or de facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen
- Be in Australia when you apply for this visa and when the file is at the final stage or at the decision stage, applicant must be in Australia at that time. This will give you temporary visa for two years.
With this visa you can
- Live, work and study in Australia
- Travel to and from Australia as many times as you want
- Attend free English language classes provided by the Adult Migrant English Program
You pay for the temporary and the permanent visa at the same time
Onshore –Subclass 801- after 2years of ongoing relationship, applicant is eligible for Permanent Option.
Partner (Provisional) visa 309 (offshore)
This visa permits the Spouse or defacto Partner of an Australian Permanent resident, Australian Citizen or Eligible New Zealand Live in Australia Temporarily.
Getting this visa is the first step towards a permanent Partner visa (subclass 100).
To be eligible for 309 visa ,one must be
- Married applicants must usually, be 18 or older when they apply. This is because usually, you must be 18 or older to be married under Australian law.
- Applicants in de facto relationships must be 18 or older when they apply.
- It is a temporary visa of 2 years which states that after two years of continuous relationship, you get permanent visa
- Need to provide evidence even after 2 years of ongoing relationship
- It leads directly to the permanent Partner visa
- usually, be outside Australia when you apply and when the visa is granted
- You and your spouse members must meet all visa conditions and obey Australian laws
With this visa you can
- stay in Australia until we decide your permanent Partner (Migrant) visa (subclass 100) or the application is withdrawn
- work in Australia
- study in Australia (you will not receive government support)
- travel to and from Australia as many times as you want
- attend up to 510 hours of free English language classes provided by the Adult Migrant English Program
- enrol in Australia’s public health care scheme, Medicare

Remember - To get the permanent Partner visa (subclass 100), you must hold this subclass 309 visa. If you are granted any other visa, the new visa will replace your subclass 309 visa. This means you can't be granted a permanent Partner visa (subclass 100).
